CHAPTER 298.

AN ACT to repeal Sections one hundred sixty-four,
one hundred and sixty-five, one hundred and
sixty-seven, and one hundred and sixty-nine, of
an Act prssed January session, eighteen hun-
dred and sixty-eight, Chapter eighty-seven,
"entitled an Act to add additional Sections to
Article eleven of the Code of Public Local Laws
of Frederick County," relating to the powers
and duties of the Mayor, Aldermen, and Com-
mon Council of Frederick, to follow Sections one
hundred and sixty-one, and to substitute in lieu
of Sections one hundred and sixty-four, one hun-
dred and sixty-five, one hundred and sixty-seven,
and one hundred and sixty-nine the following.

 

SECTION 1. Be it enacted by the General Assembly
of Maryland, That sections one hundred and sixty-
four, one hundred and sixty-five, one hundred and
sixty-seven, and one hundred and sixty-nine, of an
Act passed January session, eighteen hundred and
sixty-eight, Chapter eighty-seven, entitled "an
Act to add additional Sections to Article eleven
of the Code of Public Local Laws of Frederick
County," relating to the powers and duties of the
Mayor, Aldermen and Common Council of Fred-
erick to follow Section one hundred and sixty-one,
be, and the same are, hereby repealed, and that
the following be enacted in lieu of, and as a sub-
stitute for said actions, one hundred and sixty-
four, one hundred and sixty-five, one hundred and
sixty-seven, and one hundred and sixty-nine.

Repealed and
re-enacted.

164. The Mayor, Aldermen and Common Coun-
cil of Frederick shall have full power to provide
for laying out, opening, extending, widening,
straightening or closing up, in whole or in part,
any street, lane or alley, within the police limits
of Frederick City, which in their opinion the pub-
lic welfare or convenience may require; to provide
for ascertaining whether any, and what amount
in value of damage, will be caused thereby,
and what amount of benefit will thereby accrue to
the owner or possessor of any ground or improve-
