said persons shall fail to agree upon and ascertain
the amount of such damages, they shall select a
third person as umpire, whose award or that of
any two of them, certified in writing under their
hands and seals shall he final, and the said Com-
missioners shall thereupon levy and assess upon
the taxable property of said town, and cause the

tled thereto, the said damages and all costs which
may arise or become due and payable by reason of
the removal of the said house or houses, and the
straightening and widening of said streets, lanes
and alleys', and they may also cause the streets,
lanes and alleys of said town to be paved, and may
further cause a register to he made and kept, and
from time to time corrected, of all persons entitled
to vote in said town.

Sec. 3. And be it enacted, That this Act shall
take effect from the date of its passage.

CHAPTER 241.

AN ACT to repeal sections five and six of the Act
of eighteen hundred and sixty-four, chapter one
hundred and twenty-one, an Act repealing sec-
tions twenty-three, thirty-one, thirty-two, thirty-
three, thirty-five, fifty-three and fifty-four of the
first Article of the Code of Public Local Laws
of Allegany County, relating to the charter of
the city of Cumberland, and to re-enact the
same with amendments.

Repealed.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That Sections five and six of the Act
of eighteen hundred and sixty-four, chapter one
hundred and twenty-one, an Act repealing sections
twenty-three, thirty-one, thirty-two, thirty-three,
thirty-five, fifty-three and fifty-four of Article first
of the Code of Public Local Laws relating to Alle-
gany County, he and the same is hereby repealed,
and the following is enacted in its stead, to read
as follows:
