Maryland Manual 1994-1995

The Maryland State Board of Contract Appeals
was formed in 1980 (Chapter 775, Acts of 1980).
The Board, with expanded jurisdiction, replaced the
Department of Transportation Board of Contract
Appeals (Chapter 418, Acts of 1978).
The Maryland State Board of Contract Appeals
adjudicates disputes concerning the formation of State
contracts, except those for procurement of architec-
tural and engineering services. Contract formation
disputes pertain to the qualification of bidders or
offerers and the determination of the successful bidder
or offerer. The Board also adjudicates disputes relating
to a contract that has been entered into by the State,
including disagreements about the performance,
breach, modification, or termination of a contract.
Decisions of the Appeals Board are subject to judicial
review, and any aggrieved party, including a State
agency, may appeal a final decision or any part thereof.
At the request of a party to a proceeding, the Board
may subpoena witnesses and documents and may
compel the testimony of witnesses.
Published opinions of the Board are available at
the Board's offices. Circuit Courts, and through the
Maryland Institute for the Continuing Professional
Education of Lawyers (MICPEL).
The Governor appoints the Board's three members
to five-year terms with Senate advice and consent. Mem-
bers serve in a quasi-judidal capacity and must have a
thorough knowledge of procurement practices and proc-
esses. They serve full-time and receive compensation as
provided for in the budget. The chairperson is designated
by the Governor (Code State Finance and Procurement
Article, secs. 15-201 through 15-223).

Annual Report to Governor & General Assembly on
development & operation of Criminal Justice
Information System.

The Criminal Justice Information Advisory
Board was created in 1976 (Chapter 239, Acts of
1976). For budgetary and administrative purposes
only the Board is within the Department of Public
Safety and Correctional Services.
The Board advises the Secretary of Public Safety
and Correctional Services and the Chief Judge of
the Court of Appeals on the development, opera-
tion, and maintenance of the Criminal Justice Infor-
mation System. The Board monitors the System
and recommends procedures and methods for the
use of criminal history record information in re-
search, evaluation, and statistical analysis of crime.
The Board also recommends legislation to imple-
ment, operate, and maintain the System.
The Secretary of Public Safety and Correctional
Services and the Chief Judge ofthe Court of Appeals
adopt rules and regulations to establish, operate, and
maintain the Criminal Justice Information System.
These rules and regulations govern the collection,
reporting, and release of criminal history record infor-
mation by the courts and other criminal justice agen-
cies; ensure the security of the System and all criminal
history record information; and control the dissemi-
nation of criminal history record information consis-
tent with federal law and regulations. Rules and
regulations of the System also govern procedures for
inspecting and challenging criminal history record
information. In addition, they regulate the auditing of
criminal justice agencies to ensure that criminal history
records are accurate and complete, and that their
information is distributed in accordance with the law.
Under the Department of Public Safety and Cor-
rectional Services, the System's Central Repository
collects, stores, and disseminates criminal history re-
cord information. Every criminal justice agency must
report criminal history record information to the Re-
pository within certain time limits by specified report-
ing methods. To avoid duplicate reporting, the
Secretary of Public Safety and Correctional Services
and the Chief Judge of the Court of Appeals may
determine the events to be reported by each criminal
justice agency.
Any person may inspect their own criminal his-
tory record information as maintained by a criminal
justice agency. The person may challenge the com-
pleteness, content, accuracy, or distribution of such
information by giving written notice; and the per-
son has a right to have errors corrected.
The Criminal Justice Information Advisory
Board consists of eighteen members who serve
three-year terms. The Governor appoints ten mem-
bers: three persons recommended by the Secretary
of Public Safety and Correctional Services; two
