the duties of his office, or if his conduct is prejudi-
cial to the proper administration of justice. In ad-
dition, the Commission is empowered to inves-
tigate allegations made against the State
Prosecutor which, if true, may warrant his remov-
al or discipline, upon complaint or upon its own
motion. In this regard, the Commission may con-
duct hearings, administer oaths and affirmations,
issue process to compel attendance of witnesses
and the production of evidence, and require per-
sons to testify and produce evidence by granting
them immunity from prosecution, penalty, or for-
feiture.
The Commission consists of the Attorney Gen-
eral, who serves as an ex officio but voting mem-
ber, and six persons appointed by the Governor.
Of the appointed members, two persons (only one
of whom shall be a lawyer) are selected from
nominees submitted by the President of the Sen-
ate, and two persons (only one of whom shall be a
lawyer) are selected from nominees submitted by
the Speaker of the House of Delegates. These per-
sons may not be members of the General Assem-
bly or full-time State employees. One person is se-
lected from nominees submitted by the Board of
Governors of the Maryland State Bar Association.
One person is selected from nominees submitted
by the Governing Board of the Maryland State's
Attorneys' Association. This person shall be an
incumbent State's Attorney at the time of ap-
pointment and throughout his term of service on
the Commission. Members serve four-year terms.
The Governor designates the chairperson (Code
1957, Art. 10, sees. 33D-33F).

The Commission on the State Publications De-
pository and Distribution Program was created in

1982 (Chapter 912, Acts of 1982). The Commis-
sion oversees the State Publications Depository
and Distribution Program, which is part of the
State Library Resource Center at the Enoch Pratt
Free Library. Under this program, each State
agency is required to furnish the State Library
Resource Center with a sufficient quantity of the
agency's publications for the Center, in turn, to
distribute to designated depository libraries. These
libraries include the State Library Resource
Center, the Department of Legislative Reference
Library, the State Archives, the Maryland State
Law Library, the McKeldin Library of the Uni-
versity of Maryland, the U.S. Library of Congress,
and any other library designated by the Commis-
sion. As of April 1987, the following ten addition-
al libraries had been granted depository status:
Salisbury State College Library; Government Ref-
erence Service of the Washington County Free Li-
brary; Montgomery County Public Libra-
ry— Rockville Branch; Frostburg State College
Library; Southern Maryland Regional Library at
La Plata; Towson State University Library; Uni-
versity of Maryland Baltimore County Library;
Langsdale Library of the University of Baltimore;
Prince George's Community College Library; and
University of Maryland Eastern Shore Library.
Each State agency is also required to designate an
agency publications contact person and notify the
State Library Resource Center of the designation.
The Commission is authorized to promote the
effective dissemination and use of State publica-
tions, grant depository status to geographically
dispersed libraries, and adopt rules and policies
for the uniform identification, collection, distribu-
tion, accessibility, and retention of State publica-
tions. It advises the Program in implementing the
duties of the Commission, provides for access to
State publications, and reports annually to the
Governor on Program operations and effective-
ness.
Appointed by the Governor, the Commission
consists of nine members. Three represent deposi-
tory libraries, three represent State agencies, and
three are appointed from the general public.
Members serve four-year terms (Code Education
Article, sees. 23-2A-01 through 23-2A-05).
