The Land Reclamation Committee was estab-
lished in 1967 (Chapter 144, Acts of 1967). The
Committee studies, recommends, and approves
procedures for reclamation, conservation, and
revegetation of areas affected by open-pit coal
mining within the State. The Committee also re-
views all mining and reclamation plans, progress
reports, and final reports. It establishes plans and
methods of procedure, as well as practical guide-
lines, for the prompt and adequate reclamation,
conservation, and revegetation of all lands dis-
turbed by open-pit mining of bituminous coal
within the State.
The Committee consists of thirteen members.
Four representatives of the Department of Natu-
ral Resources, including a chairperson of the
Committee, are appointed to the Committee by
the Secretary of Natural Resources. One member
represents the Allegany County soil conservation
district, and one the Garrett County soil conser-
vation district. Two members are appointed by
the Governor with the advice and consent of the
Senate for three-year terms. They represent the
mining industry. The Planning and Zoning Com-
missions of Allegany and Garrett Counties are
each represented by a member who serves a three-

year term. The Secretary of Natural Resources
appoints for three-year terms two members from
the community who do not have an interest in
any mining operation. One of these must reside in
Allegany County and the other in Garrett Coun-
ty. One member of the Department of the Envi-
ronment is appointed by the Secretary of the En-
vironment (Code Natural Resources Article, sees.
7-205, 7-501 through 7-505, 7-509, 7-510,
7-515).

The Hazardous Waste Facilities Siting Board
was created in 1980 (Chapter 528, Acts of 1980).
It was placed under the Department of Natural
Resources in 1983 (Chapter 388, Acts of 1983).
The Board provides a means of establishing
properly designed and regulated hazardous waste
facilities in Maryland. It oners an alternative to
local approval of hazardous waste facilities. If, af-
ter careful study of environmental and community
impact, the Board issues a Certificate of Public
Necessity for a facility, local zoning and regula-
tion no longer apply -
The Board does not seek out sites. It reviews
applications for certificates submitted by public or
private developers. If they can gain local approv-
al, developers are not required to seek a certificate
from the Board. All facilities must also obtain a
facility permit from the Department of Health
and Mental Hygiene, as well as other required
State or federal permits.
In addition to site suitability and impact of the
facility, the Board must consider statewide needs
and problems associated with hazardous waste
management. The Board therefore has adopted
(and periodically reviews) regulations stating the
treatment and disposal needs of the State. These
regulations present the Board's findings on facili-
ties needed and conditions that might be imposed
