CLERKS OF THE COURT OF
APPEALS

The position of Clerk of the Court of Appeals
was authorized in 1780 (Chapter 23, Acts of
March Session 1780). The Clerk was appointed by
the judges of the Court. Under the several acts
reorganizing the judiciary of Maryland in 1806,
the Court of Appeals held separate terms for the
Western Shore and the Eastern Shore, and a clerk
was appointed for each shore (Chapter 55, Acts of
1804; Chapters 16, 65, Acts of 1805). Since the
adoption of the Constitution of 1851, the Court of
Appeals has held its sessions at Annapolis only and
has had only one Clerk of Court. From 1851, the
clerk held office for six years and could be
reappointed (Const. 1851, Art. 4, sec. 3). In 1867
the Clerk's office became elective (Const. 1867,
Art. 4, sec. 17). Clerks were chosen by the qualified
voters of the State. In 1939 the office again became
appointive and without limited term (Chapter 40,
Acts of 1939).

JUDGES OF THE COURT OF
SPECIAL APPEALS

The Court of Special Appeals was created in
1966 by constitutional amendment (Chapters 11,
12, Acts of 1966). Originally, there were five
judges, each elected from a special appellate cir-
cuit. In 1970 special appellate circuits were abol-
ished and one judge was then elected from each of
the first five Appellate Judicial Circuits, two from
the sixth Appellate Judicial Circuit representing
Baltimore City, and two from the State at large
(Chapter 99, Acts of 1970). The number of judges
has increased several times: from five to nine in
1970, from nine to ten in 1972 (Chapter 361, Acts
of 1972), from ten to twelve in 1974 (Chapter 706,
Acts of 1974), and from twelve to thirteen in 1977
(Chapter 252, Acts of 1977). Currently, six of the
thirteen judges are elected from the State at large.
