of the Director of the Maryland Geological Survey
and six appointed members. The Governor, with
the advice of the Secretary of Natural Resources,
appoints the members of the Council for four-year
terms. Two of the appointed members must repre-
sent the mining industries and two must be public
members with a demonstrated and continuing
interest in conservation matters (Code Natural
Resources Article, secs. 7-701 through 7-703).

NORTHEAST INTERSTATE LOW-
LEVEL RADIOACTIVE WASTE
COMMISSION

In 1983 Maryland ratified the Northeast Inter-
state Low-Level Radioactive Waste Management
Compact (Chapter 515, Acts of 1983). The Com-
pact provides for a commission consisting of a
member, appointed by the governor, from each
party state.

The Northeast Interstate Low-Level Radioactive
Waste Management Commission develops, adopts,
maintains, and implements a regional management
plan lu ensure llie safe and efficient storage,
treatment, transportation, and disposal of low-level
radioactive waste. The Commission may conduct
legislative and adjudicatory hearings and require
reports, studies, evidence and testimony to carry
out its duties. If party states fail to voluntarily
pursue the development of treatment, storage, or
disposal facilities, the Commission may designate,
by a two-thirds vote, a host state where regional
facilities will be established.

The Commission may enter into agreements
with any person, state, regional body, or group of
states for the importation of waste into the region
and for the right of access to facilities outside the
region for wastes generated within the region.
Authorization to import requires a two-thirds
majority vote of the Commission and an affirma-
tive vote of the representatives of the host state in
which any affected regional facility is located. This
power can only be used after the Commission and
the host state have assessed the affected facilities'
capability to handle such wastes and evaluated
relevant environmental, economic, and public
health factors, as defined by the appropriate regu-
latory authorities.

Upon petition, the Commission may grant to an
individual who produces or processes low-level
radioactive waste, or to a group of such generators
in the region, the right to export wastes to a facility
located outside the region. This right shall be
granted for a period of time and amount of waste,
and on such other terms and conditions as deter-
mined by the Commission and approved by the
affected host states.

The Commission reviews the capability of party
states to ensure the siting, operation, post-closure
observation and maintenance, and institutional
control of facilities within the region. After public
notice and opportunity for comment, the Commis-
sion may establish procedural regulations to ensure
efficient operation, orderly gathering of informa-
tion, and protection of affected persons' rights of
due process (Code Health-Environmental Article,
secs. 7-301 through 7-310).

The Interstate Oil Compact was executed in
Dallas, Texas, on February 16, 1935. Maryland
ratified the Compact in 1959. Under the provisions
of Chapter 390, Acts of 1959, Maryland entered
into the Compact with thirty-three other states to
formulate plans to conserve oil and gas.

Membership on the Commission consists of the
Governor of each signatory state together with an
alternate representative (Code Natural Resources
Article, secs. 6-401 through 6-404).
