the Governor the name of the person or persons it
finds to be legally and professionally qualified. The
Commission reports to the Governor in writing
within seventy days after notification that a vacan-
cy exists or is about to occur. The Governor
exercises his power of appointment or rejection
within thirty days of receipt of the Commission's
report.

The Commission may reprimand or recommend
to the Governor the removal from office of the
State Prosecutor if after a hearing it finds that he is
guilty of misconduct in office, fails to perform the
duties of his office, or if his conduct is prejudicial
to the proper administration of justice. In addition,
the Commission is empowered to investigate alle-
gations made against the State Prosecutor which, if
true, may warrant his removal or discipline, upon
complaint or upon its own motion. In this regard,
the Commission may conduct hearings, administer
oaths and affirmations, issue process to compel
attendance of witnesses and the production of
evidence, and require persons to testify and pro-
duce evidence by granting them immunity from
prosecution, penalty, or forfeiture.

The Commission consists of the Attorney Gener-
al, who serves as an ex officio but voting member,
and six persons appointed by the Governor. Of the
appointed members, two persons (only one of
whom shall be a lawyer) are selected from among
two or more nominees submitted by the President
of the Senate, and two persons (only one of whom
shall be a lawyer) are selected from among two or
more nominees submitted by the Speaker of the
House of Delegates. These persons may not be
members of the General Assembly or full-time
State employees. One person is selected from
among one or more nominees submitted by the
Board of Governors of the Maryland State Bar
Association, Inc. One person is selected from
among one or more nominees submitted by the
Governing Board of the Maryland State's Attor-
neys' Association, Inc. This person shall be an
incumbent State's Attorney at the time of appoint-
ment and throughout the term of service on the
Commission. Members serve four-year terms and
are eligible for reappointment. The Governor des-
ignates the chairperson (Code 1957, Art. 10, secs.
33D-33P).

The Commission on the State Publications De-
pository and Distribution Program was created by
Chapter 912, Acts of 1982. The Commission
oversees the State Publications Depository and
Distribution Program, which is part of the State
Library Resource Center at the Enoch Pratt Free
Library. Under this program, each State agency is
required to furnish the State Library Resource
Center with a sufficient quantity of the agency's
publications for the Center, in turn, to distribute to
designated depository libraries. These libraries in-
clude the State Library Resource Center, the
Department of Legislative Reference Library, the
State Archives, the Maryland State Law Library,
the McKeldin Library of the University of Mary-
land, the U. S. Library of Congress, and any other
library designated by the Commission. As of July
1, 1984, the following additional libraries had been
granted depository status: Salisbury State College
Library; Government Reference Service of the
Washington County Free Library; Montgomery
County Public Library—Rockville Branch; Frost-
burg State College Library; Southern Maryland
Regional Library at La Plata; Towson State Uni-
versity Library; University of Maryland Baltimore
County Library; and Langsdale Library of the
University of Baltimore. Each State agency is also
required to designate an agency publications con-
tact person and notify the State Library Resource
Center of the designation.

The Commission is authorized to promote the
effective dissemination and use of State publica-
tions, grant depository status to geographically
dispersed libraries, and adopt rules and policies for
the uniform identification, collection, distribution,
accessibility, and retention of State publications. It
advises the Program in implementing the duties of
the Commission, provides for access to State
publications, and reports annually to the Governor
on Program operations and effectiveness.

Appointed by the Governor, the Commission
consists of nine members. Three represent deposi-
tory libraries, three represent State agencies, and
three are appointed from the general public. Mem-
bers serve four-year terms (Code Education Arti-
cle, secs. 23-2A-01 through 23-2A-05).
