The Commission consists of fourteen members
appointed by the Governor. Five members repre-
sent the State Health Systems Agencies, six mem-
bers represent the health care providers, two
members represent the general public, and one
member serves as the designee of the Secretary of
Health and Mental Hygiene. The executive direc-
tor, who is appointed by the Governor with the
advice of the Secretary, is responsible for the ad-
ministration of the State agency and for the per-
formance of its functions.
Also established under the same statute are lo-
cal health planning agenices serving gubernator-
ially-designated health service areas of Maryland.
These agencies are required to assure broad citi-
zen representation on their boards and in their
activities, to develop local health plans, to pro-
vide input into the development of statewide cri-
teria and standards for Certificate of Need and
health planning, and to provide input into eviden-
tiary hearings on the evaluation of Certificate of
Need applications. There are at present five such
agencies. They are: 1) Health Systems Agency of
Western Maryland, serving Garrett, Allegany,
Washington, and Frederick counties; 2) Mont-
gomery County Health Systems Agency; 3)
Southern Maryland Health Systems Agency, serv-
ing Prince George's, Charles, Calvert, and St.
Mary's counties; 4) Central Maryland Health
Systems Agency, serving Baltimore City and
Anne Arundel, Baltimore, Carroll, Harford, and
Howard counties; and 5) Health Planning Coun-
cil of the Eastern Shore, serving Cecil, Kent,
Queen Anne's, Talbot, Caroline, Dorchester,
Wicomico, Somerset, and Worcester counties.

The Office of Regulatory Services performs five
functions. It licenses, certifies, or accredits health
facilities and community health programs; exam-
ines and licenses health professionals; assures
equal access to health care services; serves as ad-
vocate for developmentally disabled persons in
Maryland; and registers establishments autho-
rized to manufacture, dispense, or administer con-
trolled dangerous substances. Each of these re-
sponsibilities has as its primary goal the
upgrading of health care services in Maryland.

The Licensing and Certification Division is re-
sponsible for licensure of all hospitals and health-
related institutions in Maryland. The Division is
also responsible for certification recommendations
for all facilities participating in the Medicaid and
Medicare Programs. It inspects facilities and pro-
vides consultation and education for all health fa-
cility staffs. The Division initiates administrative
action against those facilities not in compliance
with State rules and regulations.

As part of the regulatory services function, this
Office exercises Department-wide responsibilities
to ensure that no client of any federally assisted
program is discriminated against because of race,
color, or national origin.
DEVELOPMENTAL DISABILITIES
COUNCIL

Authorized by Public Law 95-602, the Devel-
opmental Disabilities Council is appointed by the
Governor. The Office of Regulatory Services
furnishes administrative support and guidance to
the Council. The Council is an advocate and rep-
resentative of almost 153,000 developmentally
disabled persons in Maryland. The Council pro-
vides information and referral sources within
Maryland, contributes to State and federal legis-
lation pertinent to the handicapped, and draws
attention to issues affecting the disabled.

The Division of Drug Control is responsible for
enforcing the provisions of the Controlled Dan-
gerous Substance Act (Code 1957, Art. 27, secs.
276-302). The Division's programs, dealing pri-
marily with physicians, dentists, veterinarians,
pharmacists, manufacturers, distributors, non-
pharmacy establishments, and pharmacies, ensure
the availability of drugs for legitimate medical
and scientific purposes and prevent abuse which
could result in a serious health problem not only
to individuals but to the welfare of the people of
the State of Maryland.
