This Board was established by Chapter 884,
Acts of 1980, to study the implications of the lia-
bility of individuals engaged in activities of State
and local governmental and quasi-governmental
volunteer units. The eleven members of the Board
include a designee of the Maryland Commission
on Intergovernmental Cooperation, two members
of the House of Delegates appointed by the
speaker, two members of the Senate appointed by
the president, a designee of the Maryland Associ-
ation of Counties, a designee of the Maryland
Municipal League, a designee from the Maryland
Technical Advisory Service at the University of
Maryland, a designee from the Governor's Office,
a designee of the Maryland State Bar Association,
a representative of the Insurance Commissioner's
Office, and two members appointed by the gover-
nor who represent special taxing districts, one of
whom shall represent a civic association acting as
the governing body of a special taxing district.
The governor designates one member as chair-
person of the Board. Members receive no com-
pensation.

The Advisory Board is to review lawsuits in-
volving State and local officials and civic organi-
zations acting as governing bodies of special
taxing districts and to evaluate the extent and de-
gree of protection offered to state and local offi-
cials under the sovereign immunity doctrine. The
Board is to evaluate the potential liability of spe-
cial taxing districts and their officers created by
State, county, or municipal governments, and of
civic organizations acting as governing bodies of
special taxing districts. The Board is to issue a fi-
nal report with recommendations for changes in
the law regarding liability of governmental, quasi-
governmental, and civic associations to the Gov-
ernor and General Assembly by December 1980.
Unless extended by legislation, the Board will ter-
minate with the adjournment of the 1981 session
of the General Assembly.

The General Assembly created the State Lot-
tery Agency by Chapter 365, Acts of 1972 (Arti-
cle 88D of the Annotated Code of Maryland) for
the purpose of generating revenue to help support
the operation of the State. The establishment of
the Agency was contingent upon the adoption of
an amendment to Article III, Section 36, of the
Constitution of Maryland. The amendment was
ratified by referendum on November 7, 1972, and
accordingly the Agency commenced operation on
January 2, 1973, under the guidance of a Commis-
sion and the immediate supervision of a Director.

The Commission consists of five members, all
of whom are appointed by the Governor with the
advice and consent of the Senate of Maryland for
specified terms. The Commission members annu-
ally elect one member as Chairperson of the
Commission.

The Agency is under the immediate supervision
and direction of a Director appointed by the
Governor with the advice and consent of the Sen-
ate. The Director is aided by three Deputy Direc-
tors who are appointed by him.

The Agency conducts a statewide lottery oper-
ation from its Baltimore headquarters consisting
of weekly and daily games. For the weekly game
a distribution and collection system is maintained
with the cooperation of commercial banks in vari-
ous areas of the State for the purpose of distribut-
ing weekly lottery tickets, retrieving unsold week-
ly tickets, and collecting weekly lottery revenues
due. The actual lottery ticket sales outlets consist
of retail establishments such as drug stores, food
stores, and liquor stores. Weekly televised draw-
ings are held and prizes are claimed through any
of the Claim Centers located in selected existing
commercial establishments and public facilities
throughout the State. Pot-of-Gold drawings are
held periodically.

In July 1976, the Agency began a legal pick-
your-own three-digit daily lottery called "The
Numbers Game", which is patterned after the il-
