to be abridged, suspended or withdrawn, or by ordering such
offender to be whipped, not exceeding twenty lashes, and kept
at hard labor, for any number of days not exceeding twenty-one ;
and if any overseer shall receive into the alms-house any person
not having or wearing such badge, he shall forfeit and pay the
sum of fifteen dollars.
30. All penalties and forfeitures imposed by this law, shall be
recovered in the Criminal Court of Baltimore, by action of debt,
or by indictment.
81. All sheriffs, bailiffs, constables and other officers, shall aid
and assist the said trustees, and the officers by them appointed,
in the discharge of their respective duties.
32. If any person shall at any time be sued or prosecuted for
anything done in pursuance of this law, or anything therein con-
tained, be may plead the general issue, and giye the special
matter in evidence; and if, upon trial, verdict shall be found for
the defendant, or if the plaintiff shall be non suit or discontinue,
the defendant shall recover treble costs, and if the plaintiff shall
be unable to pay them, they shall be paid by the attorney who
brought the suit, unless the plaintiff shall give security for the
costs, to be approved by the court.
83. The alms-house property, heretofore jointly owned by
Baltimore city and Baltimore county, shall continue to be jointly
used and occupied by the said county and city, under such regu-
lations as the said trustees shall from time to time agree upon
and prescribe, unless by the joint consent of the county commis-
sioners of said county, and the mayor and city council of Balti-
more, any change in the use and occupation shall be made; power
and authority to make which change, is hereby vested in the
county commissioners and the mayor and city council.
34. The county commissioners of Baltimore county shall annu-
ally, at their meeting for making the county levy, nominate and
appoint one sensible and discreet inhabitant, residing in each
election district of said county, to be a manager of the poor of
the district in which he shall reside; and the mayor and city
council of Baltimore shall, at their first annual meeting, nominate
and appoint one sensible and discreet inhabitant, residing in each
ward of the city of Baltimore, to be a manager of the poor of the
ward in which he shall reside.
