•which shall be recorded in the office of the clerk of the Circuit
Court for said county in the same manner as deeds are re-
corded.
82. No such survey shall embrace any rocks whereon oysters,
clams or other shell fish are growing at the time of the making
thereof.
83. If any person shall be found guilty of stealing or other-
wise feloniously taking oysters, clams or other shell fish so laid
out or planted, he shall be punished as in other cases of theft or
felony.
84. No person, under any pretext whatever, shall rake or take
away any shells from any of the rocks or flats whereon oysters
grow within the limits of Worcester county.
85. Any person convicted of violating the provisions of the
last aforegoing section, before a justice of the peace for said
county, shall forfeit his boat or vessel, and pay a fine of not less
than one nor more than twenty dollars.
86. Any justice of the peace for said county, on information of
any violation of the provisions of section 84 of this article, shall
issue a writ of citation to some constable or the sheriff of said
county to summon and take in custody the parties charged, and
have them before some justice of the peace to answer the charges
and be dealt with as prescribed in the preceding section.
87. The boat or vessel thus condemned shall be sold by the
constable or sheriff at public sale, after five days' notice, and
one-half of the fine and proceeds of sale shall be divided between
the constable or sheriff and the informer, and the other half be
paid to the county commissioners for the use of the county.
88. If any negro shall be convicted of violating the provisions
of section 84 of this article, and shall not be able to pay the fine,
the justice may order not more than thirty-nine lashes to be
given to such offender.
89. No person residing out of the limits of this State shall
shoot at wild fowl, or take or carry away oysters or terrapins in
the waters of Synnapnxent Bay and its tributaries in Worcester
county, and any person so offending shall be fined not less than
