326. Whenever a majority of the property holders on any
one street or square of a street in said town shall determine to
have said street or square macadamized, paved, gravelled or
otherwise improved, and shall certify the same in writing to the
burgess and commissioners, the burgess and commissioners shall
cause the same to be done; and may levy an ad valorem tax on
all .the property on said street or square, for such sum as may
be necessary to pay for such improvement, to be collected by
the town collector in the same manner and by the same means
as other town taxes, and the said improvements, when finished,
shall be kept in repair as provided in the two preceding sec-
tions.
327. The burgess and commissioners may direct by ordinance
all or any of the footways in the said town to be laid off, levelled
and paved or mended and repaired, with any materials they may
think proper, and the same shall be done at the expense of the
proprietors of the different lots in front of which the same shall
be done.
328. If the owner of any house, lot or part of a lot where
such levelling, paving or repairing shall be directed to be done,
shall not reside in the town, the tenant or person occupying the
same,or who shall have charge and care thereof, shall cause such
work to be done; and the money expended by such tenant or
other person in obedience to the ordinance of the corporation,
shall be allowed by the owner, and deducted from the rent then
due or to become due.
329. If any owner or tenant of any house or lot, or part of a
lot, or the person having the care of the same, shall refuse or
neglect to level, pave, mend or repair the footway in front
thereof, in obedience to the ordinance of the corporation, the
burgess and commissioners may have such work done, and may
recover the expense thereof, with costs, by distress and sale of
such property.
330. The market house in said town shall be under the con-
trol, management and direction of the burgess and commis-
sioners, who shall appoint such officers as they may think neces-
sary, and control the same in their discretion, for the benefit and
convenience of the inhabitants of the town, and may if the
rents of the stalls and stands in said market house shall be in-
sufficient to keep the same in repair and pay the salary of the
