926 WASHINGTON COUNTY. [ART. 21.

execute the duties appertaining to the office of school commis-
sioner, or trustee, as the case may be;" and the said oath shall
be administered free of charge.

279. The board of school commissioners shall be allowed such
compensation as may be determined on by said board, not ex-
ceeding one dollar for each day they may be occupied in the
discharge of the duties of their office, and said per diem and all
other necessary expenses connected with the duties of said
board, shall be paid out of the school fund of the county.

SHARPSBUBG.

280. The citizens of the town of Sharpsburg and Miller's Addi-
tion to Sharpsburg, in Washington county, are a body corporate
by the name of "The Burgess and Commissioners of Sharps-
burg," and by that name may sue and be sued, and may have
and use a common seal.

281. The free white male citizens of said town, of the age of
twenty-one years and upwards, who have resided therein for six
months next preceding the election, shall, on the first Wednesday
in September, or on some other day to be fixed by the'ordinances
of the said town, annually elect a burgess, assistant burgess and
five commissioners of Sharpsburg, who shall have the same quali-
fications as the voters.

282. All elections shall be held and conducted as shall from
time to time be directed by the by-laws of the corporation, not
contrary to the provisions of this charter.

283/ If, during the year for which they were elected, the bur-
gess, assistant burgess, or any of the commissioners shall die,
remove from the town, resign, be non compos mentis, or displaced,
an election to fill the vacancy shall be held, after ten days' notice,
at which all persons shall be entitled to vote who are qualified to
vote at a regular election.

284. If at any election a choice of burgess, assistant burgess
and commissioners shall not be made-by a tie or equality of votes,
a second election shall be held after not less than ten days' notice,
and so on, until such choice shall be made; and the burgess and
commissioners for the time being shall continue in office until
their successors be duly elected.
