by the by-laws of the corporation, not inconsistent with this
charter.
64. If at any election a choice of burgess, assistant burgess
and commissioners shall fail to be made by a tie or equality of
votes, a second election shall be held after not less than ten days'
notice, and so on until such choice be made, and the burgesses
and commissioners for the time being shall continue in office
until their successors shall be duly elected.
65. If, during the year for which they were elected, the bur-
gess, assistant burgess, or any of the commissioners shall die,
resign, remove from said town, or be from any cause disqualified,
an election to fill such vacancy shall be held, of which ten days'
notice shall be given, and all persons qualified to vote at a
regular shall be entitled to vote at any special election.
66. The burgess shall, before he acts as such, make oath before
some justice of the peace for Washington county, that he will
well and faithfully, without favor, affection or partiality, execute
the office of burgess to the best of his knowledge, and each com-
missioner shall also, before he acts as such, make oath before
some justice of said county that he will faithfully and honestly,
to the best of his skill and judgment, exercise the powers given
and discharge the duties of him required as commissioner of
Clearspring, impartially and without favor or resentment, and
without delay.
67. The burgess and commissioners, or a majority of them,
may meet from time to time, as often as occasion may require,
upon the business of the town, and not less than once in every
three months; the burgess shall preside at all meetings of the
corporation, and shall have the privilege of the casting vote only;
in his absence the assistant burgess shall preside, under the same
restrictions; but when the burgess is present the assistant bur-
gess shall have the same power as a commissioner.
68. They may appoint a clerk and assign his duties, and allow
him such compensation for his services as they may think
proper.
69. The clerk shall enter all ordinances passed by the burgess
and commissioners in a book to be kept by him for that purpose,
and they shall at all times be open to the inspection of any per-
