96*. Each pupil shall pay to the teacher one dollar per quarter,
in advance, the same to be deducted from his quarterly salary;

unless the parent or guardian of said pupil shall be unable to pay
the same; in that case the commissioner of each district shall
admit such pupil free of charge, and the ability or inability of
the parent or guardian to pay shall be determined by the board
of county school commissioners.

97*. No money shall be paid to Montgomery county on account
of the State school fund, except upon the draft of the treasurer
of the board of school commissioners of Montgomery county,
countersigned by the president of said board; Provided, that none
of the provisions of this article shall be construed to interfere
with the appropriation now made by the State to the Rockville
and Brookeville academies in said county.

SHERIFF.

98. The sheriff of said county shall hold his office at the court-
house, or within a quarter of a mile thereof, and shall attend at
said office at all times, (Sundays excepted,) in person or by
deputy, for the transaction of business, under the penalty of
forty dollars for each month he shall fail to comply herewith,
to be recovered by indictment in the Circuit Court for the use
of the county.

99. He shall be entitled to twenty-five cents a day for keeping
and boarding each prisoner committed to the jail of said county.

WITNESSES.

100. The county commissioners of said county, at the time
and in the manner hereinbefore prescribed as to jurors, shall
levy for the payment of witnesses attending the Circuit Court
for said county, and payable by the county; and the collector
of said county shall pay such witnesses at the same time and
upon the same evidence required to authorize the payment of
jurors.
