42. They may make such by-laws for the regulation and good
government of said town and the inhabitants thereof, to restrain
disorders and disturbances, and prevent and remove all nuisances
within said town, as to them, or a majority of them, may seem
proper, not inconsistent with the laws of this State, and may
enforce the observance thereof under such penalties, fines and
forfeitures as they shall deem proper, not exceeding five dollars
for any one offence, and all such fines, penalties and forfeitures
may be recovered before a justice of the peace as small debts.

43. They may appoint and qualify one or more active and dis-
creet persons as bailiffs of said town, and may prescribe their
duties, and may allow their clerk and bailiff such compensation
as they may deem reasonable.

44. The said clerk and bailiffs, before they enter upon the
duties of their office, shall severally make oath before one of
said commissioners that they will faithfully and impartially
perform the duties of their respective offices according to the
best of their skill and judgment, without favor, partiality or pre-
judice.

45. The bailiffs shall attend the said commissioners at their
several meetings; shall perform such services as the commis-
sioners shall direct; shall prevent the tumultuous and irregular
meetings of slaves and negroes within the limits of the town, or
if so assembled, shall disperse them by reasonable and lawful
means, and shall punish by moderate correction, under such rules
and. regulations as shall be prescribed by said commissioners, all
such negroes or slaves as shall be found strolling about the
streets at night, and shall exercise all the powers of a constable
within said town.

46. The said commissioners shall cause an assessment and
valuation of all the real property and houses within the limits
of said town, to be made and returned to them annually, between
the tenth of June and the tenth of July, if they shall deem the
aame necessary, by such person or persons as they shall appoint
for the purpose, and may levy on the property so assessed such
sum of money as they may deem necessary, not exceeding twenty
cents in the hundred dollars in any one year, and may appoint
and qualify a person to collect the same.
