issue his warrant to apprehend such owner and take him before
some justice of the peace of the county, and he shall, by the
justice before whom. he may be taken, be compelled to enter
into recognizance for. his appearance at the next term of the
Circuit Court for Harford county.
39. The person so arrested shall be proceeded against by in-
dictment in the Circuit Court aforesaid, and upon conviction or
confession of the offence charged, shall be fined by the court not
exceeding sixty dollars for any such offence, one-half to the
constable aforesaid, or such other person as shall prosecute for
the same, the other half to the use of the county.
40. The said constable, for the discharge of the duties afore-
said, and upon his making the oath thereto, shall be allowed
by the county commissioners the sum of sixteen dollars per
annum.
41. If any person using a fishery on the west side of the Sus-
qnehanna River, shall, for the space of ten days after the ex-
piration of the fishing season, neglect to remove any putrefying
pickle from the fishing shore, and cleanse the vessels used in
curing fish, or suffer quantities of fish to remain and putrefy on
the fishing shore, he shall forfeit the sum of five dollars, and
shall immediately remove such putrid fish and pickle, and
cleanse the vessel used in curing fish, and on refusal or neglect
so to do for the space of five days thereafter, shall forfeit the
sum of twenty dollars; the said penalties to be recovered before
a justice of the peace for Harford county as small debts, the one-
half to the informer and the other half to the county.
HAVRE DE GRACE.
42. The citizens of Havre de Grace, in Harford county, are a
body corporate, by the name of (< The Commissioners of Havre
de Grace," and by that name may sue and be sued; may have
and use a common seal, and may purchase and hold any pro-
perty, real, personal or mixed, and dispose of the same for the
benefit of said town.
43. The limits of the town of Havre de Grace shall be 88 fol-
lows: Beginning for the same at the north end of Lycoming
street, as designated on the map thereof by Septimus Norris in
the year eighteen hundred and thirty-eight, and running thence
