annually to the commissioners the general state of the town,
with an accurate account of the money received and expended,
to be published in the most public places in the town, for the
information of the citizens.
73. All other officers not herein named, who may be deemed
necessary to execute the powers of the said corporation, and the
laws thereof, shall be appointed in such manner as shall by ordi-
nance be directed.
74. The citizens of said town, and all persons holding property
therein, shall be competent witnesses in all actions arising under
this charter, or the by-laws and ordinances of said corporation,
if exempt from other exceptions than those of interest, as an
inhabitant of the said town, or member of said corporation.
75. All moneys arising from taxes, fines, forfeitures, and pe-
nalties, imposed by virtue of any by-law or ordinance of said
corporation, shall be appropriated to the uses thereof, in such
manner as may by ordinance be directed.
76. All fines, penalties and forfeitures under the by-laws or
ordinances of the corporation, shall be recovered before the bur-
gess or before a justice of the peace for Frederick county, upon
warrant against the offender, directed to any constable of the
county, or of said corporation; and the said constable shall
serve the same under the same penalties as in cases of summons
for small debts, from a justice of the peace, and shall receive the
same fees therefor, to be paid by the corporation.
77. The burgess, or any justice of the peace, when imposing
any fine, penalty, or forfeiture, for the violation of any ordinance
of said corporation, shall order the person convicted to be com-
mitted to the public jail, (or an appropriate place of confinement
within the corporation, which the burgess and commissioners
may provide,) if he shall fail or refuse to pay the fine, penalty,
or forfeiture and costs; there to remain until the same is paid,
or until discharged, as hereinafter provided; and the sheriff of
said county shall receive and safe keep such person, according
to the tenor of the commitment, and shall be entitled to his usual
fees therefor, and the burgess or justice who may have directed
such commitment may order any person so committed to be dis-
charged.
