by them respectively, as may be necessary for the repair of the
roads therein.
95. Any person who, when required under the preceding sec-
tion to furnish his proportion of labor upon the public roads in
his district, shall neglect or refuse to furnish the same, shall for-
feit not exceeding two dollars a day for each laborer refused or
neglected to be sent under such requirement, and the county
commissioners shall add the same to the other taxes of such
delinquent, to be collected therewith.
96. The county commisaioners of said county shall, at least
sixty days before an election of road supervisors in said county,
determine what amount of salary each supervisor shall receive
for the ensuing year, and so from year to year determine his
salary; or they may, instead of a fixed and regular salary, fix
and determine a certain per diem compensation to the super-
visors.
97. They may, when they deem it expedient, require the super-
visor to appoint a sufficient number of deputy supervisors, and if
the supervisors shall for twenty days thereafter fail so to appoint
deputies, they may appoint the same, prescribe their duties and
fix their compensation.
98. In all cases where a certain annual salary is determined
upon, the compensation to the deputies shall be paid out of said
salary, and where a per diem is determined upon, a per diem
shall also be fixed for the deputies.
99. The county commissioners of said county may levy upon
the assessable property of the county and pay the expenditures
for the repair of the roads and the incidental expenses thereof,
or they may levy upon each district for the amount of such ex-
penditures, and all incidental expenses thereof in such district.
100. Upon complaint, on oath, of any citizen that any part of
the roads in said county is and has been for ten days out of
repair, the county commissioners, upon being satisfied that the
supervisor has neglected to repair the same, may fine such super-
visor not less than five nor more than fifty dollars for such
neglect, and retain, the same out of any salary or compensation
provided for such supervisor,
