sioners for the time being shall remain in office until such an
nual election shall be held.
FENCES.
91. All grounds kept for enclosures in Cecil county shall be
fenced with a post and rail fence, or a worm fence well staked
and ridered, made of good and substantial rails at least four feet
and a half high from the ground to the top of the upper rail;
and all worm fences not staked and ridered shall be at least five
feet high from the ground to the top of the upper rail, and the
first, or under rail, either in post and rail or worm fences, shall
not exceed five inches from the ground, embankment or stone
wall, as the case may be, on which the same may be built, and
the distance or space between each of the three lower rails shall
not exceed five inches; all fences made of stone exclusively, and
hedges of thorn, close set, shall be at least four feet and a half
high from the ground to the top thereof.
92. If any hoi-sea, horned cattle, sheep or hogs, shall break
into any person's enclosure, the same being of the height or
sufficiency aforesaid, the owner of such horses, cattle, hogs, or
sheep shall be liable to make good all such damages to the
owner of such enclosure as shall be awarded by two respectable
landholders, who may view the same, and make such award,
under oath, taken before some justice of the peace of the county.
93. The damages so awarded may be recovered in the same.
manner as other debts. .
94. If any person not having his grounds enclosed in the
manner hereinbefore prescribed, shall hurt, kill, or do any
damage to any horse, sheep, hogs, or any kind of cattle belong-
ing to any other person, by hunting or driving them out of said
grounds, he shall pay to the owner thereof all such damages
therefor as shall be awarded by any two respectable landholders,
who may view the same, and make such award under their
oaths.

95. The damages awarded under the last aforegoing section
may be recovered in the same manner as other debts.
96. When any persons shall join fences for their mutual advan-
tage, each shall keep up and in good repair his proper proportion
