440 CECIL COUNTT. [ART. 8.

CHABLESTOWN.

32. The citizens of Charlestown who are actual residents
therein and qualified to vote for delegates to the General As-
sembly, shall, on the second Monday of January, annually, elect
five commissioners, which said commissioners are hereby incorpo-
rated by the name of " The Commissioners of Charlestown," and
the said commissioners are hereby enabled to sue and be sued,
to have a public seal with such marks and devices as to them
shall seem proper for the purpose of attesting official papers;

and to make by-laws and regulations to preserve order, remove
nuisances, and promote the welfare of said town, not contrary to
the laws of this State.

33. Everycommissioner at the time of his election shal^be an
actual resident of said town and qualified to vote for delegates
to the General Assembly; if any vacancy occurs, the remaining
commissioners shall fill such vacancy until the next general
election.

34. The said commissioners shall meet at such times as they
shall deem expedient, and may appoint a clerk to register their
proceedings, and may also appoint a bailiff of said town, who
shall, within the limits of said town and common, have all the
powers and perform all the duties of constables of Cecil county.

35. All. the public property belonging to said town shall be
vested in said commissioners, who shall use the same for the
benefit of said town, and may sell or lease the same with the
consent of a majority of the voters of said town, and may impose
fines not exceeding ten dollars for the violation of the by-laws,
which fines shall be collected in the name of the said commis-
sioners as small debts.

CHESAPEAKE CITY.

36. The citizens of Ohesapeake City and Bohemia village, in
Cecil county, are a body politic, by the name of " The President
and Commissioners of the town of Chesapeake City," and as
such shall have succession, and by their corporate name may sue
and be sued, may grant, receive and do all other acts as natural
persons, and may purchase and hold real and personal and mixed
property, or dispose of the same for the benefit of said town, and
