county in which such creek or river lies, and in case a creek or
river shall be a divisional line between two counties, then no one
shall catch or take oysters therefrom as aforesaid, unless the
person so catching and taking shall be at the time thereof a
resident of one of the counties so divided; nor shall any one
take or catch oysters as aforesaid in any of the waters of this
State within five hundred yards of the shore thereof, unless the
person so taking and catching the same shall be at the time
thereof a resident of the county bordering on such shore.
12. Any person violating the provisions of the preceding sec-
tion, shall be liable to the same forfeiture and penalties, and may
be proceeded against in the same manner by seizure of property
and arrest of person, as herein provided in cases of violation of
the first three sections of this article.
13. Any person resisting an officer in making any arrest or
seizure under the provisions of this article, shall be guilty of a
misdemeanor, and upon conviction thereof, shall be fined not
exceeding one hundred dollars, or imprisoned not more than six
months.
14. Any person offending against either of the three first sec-
tions of this article may be punished as hereinbefore provided,
or such person may be indicted by the grand jury of the Circuit
Court having jurisdiction for such offence, and on conviction shall
be fined, if he be the captain of the vessel, not less than fifty nor
more than two hundred dollars, and if one of the hands on board
of such vessel, he shall be fined not less than twenty-five nor
more than one hundred dollars.
15. Any citizen of this State owning lands lying on any of its
navigable waters, the lines whereof include any land covered by
such water, may deposit, bed or sow oysters or other shell fish
in the waters so included in the lines of his land.
16. If any creek, cove or inlet, not exceeding one hundred
yards in breadth at its mouth, makes into the land of any owner
or other lawful occupant, such owner or occupant shall have
exclusive right to use the same for depositing, bedding and
sowing oysters or other shell fish, although such creek, cove or
inlet may not be included in the lines of any patent.
