6. If any ordinary keeper referred to in the preceding section
shall cause written or printed notices to be put up in his cham-
bers and other conspicuous places about his house, notifying his
guests of the purport of the preceding section, and requesting
them to deposit their money and plate with him or his agent, to
be designated by such notice, then he shall not be responsible for
the loss by robbery or otherwise; Provided, such ordinary keeper
can prove that he has complied with the provisions of this and
the preceding section, unless such loss occurred from collusion or
positive negligence on the part of such ordinary keeper or his
agent.
ARTICLE LXXI.
Oysters.
SEC. 1. No person shall take or catch oysters in any of the
waters of this State with a scoop or drag, or any other instru-
ment than such tongs and rakes as might lawfully be used at the
adoption of this code.
2. No person who has not previously resided for twelve months
in this State, shall gather or catch oysters in any of the bays,
rivers, creeks or waters of this State, within two miles of the
shores thereof, and put them on board of any canoe, boat, scow,
flat or other vessel not wholly belonging to or owned by some
person who has resided twelve months in this State previously
thereto.
3. No person who has not resided twelve months previously
thereto in this State, shall carry oysters out of this Slate; but
citizens of other States may take and carry away oysters that
they have legally purchased from citizens of this State.
4. Any person violating any of the provisions of the preceding
sections shall pay a fine not less than five nor more than fifty
dollars, and forfeit the boat or vessel in possession of the party
so offending, tdgether with her papers, furniture, tackle and ap-
parel, and all things on board of her at the time of her seizure.
5. On information given on oath to a justice of the peace of
any violation of either of the preceding sections, he shall issue
