NAVIGATION OF VESSELS BY NEGROES.
67. It shall not be lawful for any person owning, in whole
or in part, or having hired in whole or upon shares, any
schooner, sloop, or other vessel required by the laws of the
United States to be registered, to navigate or work, or cause the
same to be navigated or worked, within the waters of the State of
Maryland, without having on board said schooner, sloop or other
vessel, at least one white man above the age of eighteen years,
under whose care the said schooner, sloop or other vessel shall
be navigated and worked.
68. If any owner or hirer of such schooner, sloop, or other
vessel, shall navigate or cause the same to be navigated, contrary
to the provisions of the preceding section, the said schooner,
sloop, or other vessel, together with all her tackle, apparel and
furniture, or the value thereof, shall be forfeited, one-half to the
State, and the other half to the informer.
69. Upon information given to a justice of the peace, upon
oath, that any schooner, sloop or other vessel, is navigated con-
trary to the provisions of this article, he shall issue his warrant
to some constable, commanding him to seize said vessel, tackle,
apparel and furniture, and the constable shall seize such vessel,
tackle, apparel and furniture, and give notice of the seizure to
the owner thereof, and summon him to appear before such
justice; and upon return of said warrant before said justice,
he shall give judgment of condemnation of such vessel, tackle,
apparel and furniture, if in his opinion she is navigated con-
trary to the provisions aforesaid; Provided, said justice shall
be satisfied the owner of said vessel has been duly summoned
or notified.
70. Upon judgment of condemnation so rendered, the con-
stable shall sell said vessel, tackle, apparel, and furniture, at
public sale for cash, to the highest bidder, having first given
ten days' notice of such sale, and shall, after deducting the legal
costs and charges of condemnation and sale, pay to the informer
one-half of the proceeds thereof, and the other half to the
Treasurer of the State.
71. Any person who shall feel himself aggrieved by any judg-
ment of condemnation so rendered, may appeal to the Circuit
Court of the county, or the Court of Common Pleas, if in the
