such musket or firelock in serviceable order, and it shall appear
to be from his own default, he shall forfeit one dollar for every
such neglect.

87. Any arsenal which has been provided and is now used by
any volunteer corps, shall be continued in the discretion of said
corps, and the expenses, when certified to the Governor as rea-
sonable and correct and by him approved, shall be a charge on
the funds derived from fines, penalties and forfeitures collected
from said corps and paid into the treasury, and shall be paid
therefrom by the Treasurer, upon the warrant of the Comp-
troller, to the paymaster of such corps or to his order.

88. Every paymaster, before he acts as such, shall give bond
and security to the State, to the satisfaction of the field officers
of the regiment, extra battalion or squadron to which he belongs,
in the penal sum of one thousand dollars, conditioned that he
will semi-annually submit to the adjutant general and the field
officers of his regiment, battalion or squadron a full and fair
statement of his accounts as paymaster as aforesaid, and pay
over all the balances remaining in his hands when demanded by
his successor in office, or by the person authorized to claim and
receive the same, and in all things faithfully to discharge the
duties of his office,

89. If any person shall sell or buy, except by the authority of
the State, any of the arms or accoutrements belonging to the
State, or give or receive the same in pledge, barter, or as a gift,
knowing the same to be public property, or shall injure or destroy
such arms and accoutrements, he shall for every such offence
forfeit and pay twenty dollars, and if such arms and accoutre-
ments shall by any of the means aforesaid be rendered useless
or become lost, such person shall also forfeit and pay the full
value thereof as fixed by the State for arms and accoutrements
destroyed or lost; and such forfeiture shall be recovered at the
instance of any commissioned officer, and be collected and paid
by the sheriff of the proper county to the Treasurer of the State

90. Whenever any of the public arms or accoutrements shall
be found in the possession of any person except as authorized
in this article or any law of this State, the same may be de-
manded by any commissioned officer, and if refused to be de-
livered up, on proof of such demand and refusal before any
justice of the peace, he shall, at the instance of such officer, by
