426 MILITIA. [ART. 63.

52. Every sheriff shall require and obtain from each of his
deputies instructed to collect militia fines, forfeitures and pen-
alties, a return under oath at least once in two months, of the
money collected by such deputy on that account, and each
deputy sheriff who shall collect any such money and neglect
to make a return thereof under oath to his principal for the
space of three months after he shall have collected the same,
shall forfeit and pay to the use of the State the sum of one
hundred dollars, which shall be collected by the sheriff who ap-
pointed him, unless remitted by the adjutant general; and the
sheriff shall pay the same when collected to the Treasurer, and
shall be entitled to retain ten per centum out of all moneys he
shall collect under this article.

53. The Treasurer shall keep an account of all the money
which shall be collected from the militia of this State for fines,
forfeitures and penalties, in such form as will best show how
much money was received by him on account of injuries to or
loss of arms and accoutrements belonging to the State, and
how much on account of fines, forfeitures and penalties, and of
this how much was paid by the privates and officers of the several
companies, extra battalions, squadrons, regiments, brigades and
divisions, and so that the surplus of said-fines, forfeitures and
penalties at any time remaining in the treasury after paying such
expenses as shall by law be charged on this resource, may be
distributed rateably among the said several corps in just propor-
tion to the aggregate collections made by them respectively.

54. The adjutant general shall provide and furnish the several
corps of militia, and the proper officers thereof, with all neces-
sary and proper forms and blanks, according to which they
shall make all the returns and reports directed to be made by
them.

55. The following articles, rules and regulations, shall be those
by which the militia of this State shall be governed:

Article 1. If any field or other commissioned officer at any
. regimental, battalion, squadron or company meeting, or on any
other occasion when the regiment, battalion, squadron or com-
pany to which he may belong or in which he holds a command
is paraded, shall misdemean himself or appear in an unofficer-like
manner, he shall for such offence be cashiered or punished by
fine, at the discretion of a brigade or regimental court martial,
