424 MILITIA. [ART. 63.

re-deliver to him the arms and accoutrements belonging to the
State which such member had received and had not returned,
and if any person shall refuse or neglect to comply with such
order for more than four days after he shall be notified thereof,
the commanding officer who gave the order shall certify such
neglect or refusal to the sheriff of his county, who shall there-
upon proceed to make and collect in the name and to the use of
the State, the sum of fifteen dollars from such delinquent, by the
same means and in the same mode and manner that he would or
might adopt or pursue to make the same upon judgment and
execution.

43. The Governor shall from time to time adopt such measures
and give such orders as he shall deem necessary for the collection,
preservation, distribution, delivery and re-delivery of the arms,
accoutrements and ammunition belonging to the State, and shall
provide and issue such ammunition as in his opinion may at any
time be necessary.

44. The commanding officer of each uniformed volunteer com-
pany and draughted company of militia shall annually in the
month of September, inspect the arms and accoutrements of the
company under his command, and shall transmit without delay a
report thereof by mail to the adjutant general's office to be therein
recorded, and shall cause a copy thereof to be entered in a com-
pany book which he shall keep for that purpose, distinguishing
therein the arms and accoutrements belonging to the State from
those which belong to individuals.

45. If the arms and accoutrements so inspected shall not be in
good order, the commanding officer making the inspection shall
cause the same to be repaired by or at the cost of the party using
and having the care thereof.

46. If any arms or accoutrements belonging to this State shall
be destroyed or lost by the negligence of any militia company to
which the same were delivered, the commanding officer of said
company shall certify such loss or destruction, and the vulue of
the arms so lost or destroyed, to the sheriff of the county in
which the person guilty of such negligence resides, and the said
sheriff shall proceed forthwith to collect the sum of money so
certified to be the value from the delinquent in the same manner
as upon an execution issued to said sheriff.
