the presentation to him of a patent by the Commissioner of the
Land Office, certified by the said commissioner as proper to be
issued, shall be authorized to sign such patent, and to cause the
Great Seal to be affixed thereto.
35. The Commissioner of the Land Office may prescribe rules
to regulate the conduct of surveyors in making surveys and
returning certificates and plats, and he shall in all things regulate
his proceedings by the usages and principles which have hereto-
fore been established by the practice of the Land Office not incon-
sistent with this article or the principles of equity.
36. Any person holding lands and being in actual possession
thereof in this State under a warrant and survey, or under a
patent granted by the government of Pennsylvania before the
divisional line between the two States was fixed, shall be entitled
to receive a patent for such land from the proper authorities of
this State.
ARTICLE LV.
Librarian-State.
SEC. 1. The State Librarian shall take and subscribe before the
Governor, the oaths prescribed by the Constitution.
2. He shall give bond to the State of Maryland in such sum,
and with such security, as the Committees of the Senate and
House of Delegates on the Library approve, for the safe keeping
of the books, maps, documents and furniture of the library, and
for the faithful discharge of his trust, according to such regula-
tions as shall from time to time be established as herein directed;
which bond shall be deposited in the Executive chamber.
3. In case of the death, disqualification, resignation, or removal
from the State, of the Librarian during the recess of the General
Assembly, the Governor shall fill the vacancy; and the person
so appointed shall continue in office until the next meeting of
the General Assembly, giving bond and security as aforesaid, to
be approved by the Governor.
