348 JOINT OBLIGATIONS AND JOINT TENANCY. [ART. 49.

20. Any person interested may appeal from the decision of
the court on any question under this article; Provided, the
appeal be taken in thirty days, and bond given to prosecute
with effect, or pay costs and damages.

21. This article is not to apply to fines and forfeitures for
violating the laws of this State, or the ordinances of any muni-
cipal corporation, but any person imprisoned for thirty days for
not paying a fine or forfeiture not exceeding fifty dollars, or for
sixty days when the fine exceeds fifty dollars, may petition and
be released from such fines as if they were common debts.

22. The provisions of this article shall not be construed to
apply to, or in any manner release, discharge or affect any judg-
ment recovered by civil action for injuries occasioned by the
seduction of any female, nor to apply to, or in any manner re-
lease, discharge or affect any judgment recovered by civil action
for damages for defaming an unmarried female.

ARTICLE XLIX.
Joint Obligations and Joint Tenacy.

JOINT OBLIGATIONS.

SEC. 1. Where two or more persons are jointly bound by bond,
promissory note, or by any other writing, whether sealed or un-
sealed, to pay money or do any other thing, and one or more of
such persons shall die, his or their executors and heirs shall be
bound in the same manner and to the same extent as if the
person so dying had been bound severally as well as jointly.

2. No person shall institute more than one suit on a joint and
several bond, penal or single bill, where the persons executing
the same are alive and reside in the same county; and if more
than one suit be instituted on any such bond, penal or single bill,
judgment of non pros, shall be entered against the plaintiff in
such suit.

3. If a joint obligor be dead when the suit is brought, his
representative may be sued.
