such shore, he shall on conviction forfeit and pay not less than
fifty dollars nor more than five hundred dollars, or be imprisoned
for not less than one month nor more than one year; this and
the preceding section not to apply to any obstruction or hin-
drance by unavoidable accident or stress of weather.
19. Any owner or occupier of a fishery on the Potomac may
cause and permit all vessels employed by him in carrying on his
business to be anchored or moored opposite his shore, but not so
as to interfere with the rights of the owners or occupiers of ad-
joining shores in laying out their seines.
20. The provisions of this article in relation to fishing on the
Potomac River shall be of no force or validity unless the same
shall have been or shall hereafter be adopted by the State of
Virginia, or similar laws be passed by that State in relation to
said river.
21. It shall not be lawful for any person, other than the owner
or by permission of the owner, to take or carry away from any
shore of the Potomac River below Fort Washington, which has
been or may be used as a fishery, any sand, gravel or other
matter that may form a part of said shore, to, the amount of ten
bushels or more, with the intention of converting the same to his
own use, and any person so doing shall be adjudged guilty of a
misdemeanor, and on conviction thereof in the Circuit Court for
the county in which such misdemeanor was committed, shall be
fined not less than five nor more than one hundred dollars, and
be confined in the county jail not less than thirty nor more than
ninety days.
PATUXENT.
22. No person shall cause to be erected any gill net, seine, or
other obstruction in the Patuxent River or its tributaries, except
citizens residing in the counties bordering on the said river or its
tributaries, and persons authorized to do so by the owner or oc-
cupier of land bordering on said river and its tributaries, and any
person so offending shall pay a fine of twenty dollars, and shall
forfeit the boat, net, seine and fishing apparatus, and any thing
on board of the boat at the time of committing the offence.
23. No person shall stake down any seine or net across the
Patuxent River for the purpose of taking shad or herrings, nor
