176 COUNTY COMMISSIONERS. [ART. 28.

10. They shall have power to open, alter or close any public
road or roads in their respective counties.

11. They may build and repair bridges, and levy upon the
property of the county therefor.

PUBLIC ROADS.

12. All applications for opening, altering or closing roads,
shall be by petition to the county commissioners.

13. Whenever any citizen or citizens of any county intend to
petition the county commissioners for opening, altering or closing
any road, they shall give thirty days' notice thereof in one or
more of the newspapers published in the county; and if no
newspaper be published in the county, they shall give public
notice of such intention by setting up a notice at the court house
door, and at three public places in the election district in which
it is proposed to open, close or alter the road, for at least thirty
days.

14. Counter petitions may be presented to the county com-
missioners, and when they are, the county commissioners shall
take into consideration the reasons contained in the counter
petition, and such other testimony as may come before them,
and determine the case as in their opinion shall seem right and
proper.

15. Whenever the county commissioners shall deem it ex-
pedient that examiners should be appointed to view the ground
. for the purpose of opening, altering or closing a road, they shall
appoint three persons as examiners, who shall be freeholders in
the county, and not interested nor holding lands through which
the said road is proposed to be opened, altered or closed.

16. The said examiners, before they proceed to act as such,
shall take an oath to execute the trust reposed in them by the
commission to them issued, faithfully and without favor, affec-
tion or partiality; which oath shall be endorsed on the commis-
sion and returned therewith.

17. They, or a majority of them, after giving thirty days'
notice in the manner hereinbefore prescribed, shall meet on the
premises and proceed to examine and determine whether the
