148. In any case in chancery upon the filing of the answer of
an infant defendant, taken in the manner prescribed by law,
admitting the facts stated in the bill, or making no defence to
the claim of the complainant, commission to take testimony may
issue at the instance of the complainant, directed to such person
as the court may appoint.
149. In all cases where any of the defendants have appeared and
answered, and a commission to take testimony has issued, and
there are other defendants who are in default for not appearing
or answering, and against whom a commission ex parte might
issue, it shall not be necessary to issue such ex-parte commission;
but the complainant may take all his testimony under the com-
mission issued as aforesaid, and such testimony shall be as avail-
able against the defendants who are in default, as if the same
was taken under an ex-parte commission.
ARTICLE XVII.
Chemist—Agricultural
SEC. 1. The Governor, by and with the advice and consent of
the Senate, shall biennially appoint and commission a person of
ability, integrity, and suitable practical and scientific attain-
ments, as Agricultural Chemist for the State.
2. If a vacancy shall occur in said office during the recess of
the Senate, the Governor shall fill such vacancy.
3. The agricultural chemist shall receive an annual salary of
two thousand dollars, to be paid as the salaries of other civil
officers; and for the purchase of chemical implements and mate-
rials, the annual sum of fifty dollars.
4. The State shall be divided into three districts, to wit: the
first shall comprise that part of the State comprised in the first
gubernatorial district; the second, that of the third guberna-
torial district; and the third, that of the second gubernatorial
district.
