CHAP. 9. This statute has been mentioned in
the note on 20 Hen. 3, Ch. 5, as repealing all former
acts, &c. against usury. Being predicated on
the rate of interest on sterling money, (which at
the time of its being passed, was 10 per cent; on
the settlement of the province, in 1633, at 8 per
cent; and since reduced to 6, and lastly to 5 per
cent,) it was not considered applicable to the circumstances
of the people of the province.
In 1684 an act was passed against excessive
usury, on the expiration of which, a new act was
passed in 1692, after the repeal of which, the act
at present in force was made, (1704, Ch. 69,) the
provisions in which, are in many respects similar
to those contained in this statute. I find but one
case of an indictment for usury, which was in
1695, and laid to be against the act of assembly.
