In an appeal of rape the defendant shall not wage
battle.

an appeal of rape, has never been extended to the
province. As to the other part respecting dower,
I do not find it noted in the English authorities,
as to what shall be a bar of dower, except in 1
Hale, 631--and in that respect the provisions in
West. 2, (13 Edw. 3, Ch. 34,) appear to be to the
same purpose.

CHAP. 4. This statute is not mentioned by
Blackstone, in speaking of the offence of embezzling
or vacating a record, but the Stat. 8, Hen. 6,
is therein referred to; but at any rate, this statute
never extended to the province, and there is
no instance of a prosecution under either. See
the act of 1715, Ch. 11, and the act of 1642, for offences
not capital. |
