REPORT:

The special committee to whom was referred the Constitu-
tion of the State, with a view of distributing such parts
thereof as require the action of this House to appropriate
committees, beg leave to report:

That sections 4 and 5 of Article 1 ; sections 33, 42, 44, 45,
47, 49, 50 and 06 of Article 3 ; sections 8, 9, 1G and 22 of
Article 4, and section 1 of Article 7, be referred to the Com-
mittee on the Judiciary;

That section 58 of Article 3 be referred to the Committee
on Ways and Means;

That section 3 of Article 7 be referred to the Committee
on the Library;

That Article 8 be referred to the Committee on Education;

That Article 9 be referred to tho Committee on Militia; and

That section 3 of Article 12 he referred to the Committee
on Internal Improvements.

The hour of 12 o'clock., M., having arrived, in accordance
with the message sent to the Senate, and in conformity with
the Act of Congress, chapter 245, entitled "an Act to regu-
late the times and manner of holding elections tor Senators in
Congress," the Senators of Maryland appeared in the ball of
the House, and the two bodies, conjointly, proceeded to hold
an election for Senator to succeed the Hon. Reverdy Johnson
in the Congress of the United States.

The roll of Senators and Members of the House of Dele-
gates being called, it, appeared by a viva voce vote of each
Senator and Member present, (a majority of all the Members
elected to both Houses being present and voting,) that

Hon. Win. T. Hamilton received 40 votes.
" Thomas Swanni " 44 "
" Thomas G. Pratt " 19 "
" B. G. Harris " 2 "
" Montgomery Blair " 1 "
" Joshua Vansant " 4 "

So it appeared that no person having received a majority
of all the votes cast ibr Senator of the United States,

Mr. Senator Earle moved that the Joint Assembly do now
proceed to take another vote.

Mr. Coudy demanded the yeas and nays.
