Which was read a first time.

Mr. Herbert submitted the following message :

By THE HOUSE OF DELEGATES,

January 15, 1868.
Gentlemen of the Senate :

In conformity with your message asking the return to your
Honorable Body of the bill entitled an Act to repeal section
40 of Article 11 of the Code of Local Laws entitled "Fred-
erick County," and to re-enact the same with amendments,
we herewith return said bill.

Which was read, assented to, and sent to the Senate.

The hour of 12 o'clock, M., having arrived, in accordance
with the message sent to the Senate, and in conformity with
the Act of Congress chapter 245, entitled "an Act to regu-
late the times and manner of holding elections for Senators in
Congress," the Senators of Maryland appeared in the hall of
the House, and the two bodies, conjointly, proceeded to hold
an election for Senator to succeed the Hon. Reverdy Johnson
in the Congress of the United States.

The roll of Senators and Members of the House of Dele-
gates being called, it appeared by a viva voce vote of each
Senator and Member present, (a majority of all the Members
elected to both Houses being present and voting,) that

So it appeared that no person received a majority of all
the votes cast for Senator of the United States.

On motion of Mr. Senator Hyland,

The joint session adjourned until to-morrow at 12 o'clock,
M.

The bill entitled an Act to incorporate the Marine Rail-
way and Manufacturing Company of Havre de Grace, and to
amend the Act of 1867, chapter 211,

Was read a second time and ordered to be engrossed for a
third reading.
