CHAPTER 455.
AN ACT to confer upon the Lumber, Mining,
Manufacturing and Improvement Company of
Allegany County, the authority to erect and
maintain a boom or booms, with piers and ne-
cessary appurtenances, upon the Great Savage
River, in Allegany County, from the National
turnpike road to or near the junction of said
river with the north branch of the Potomac
river.

SECTION 1 . Be it enacted by the General Assembly
of Maryland, That the Lumber, Mining, Manu-
facturing and Improvement Company of Allegany
County, a corporation created under the provisions
of the Maryland Code of Public General Laws, be
and the same is hereby authorized and empowered
to construct and erect, establish and maintain such
boom or booms, and such pier or piers, and other
necessary appurtenances to the same, in and upon
the Great Savage river, in Allegany County, be-
tween the point where the said river is crossed by
the National Turnpike Road and the village of
Bloomington, as may be necessary and convenient
for floating, navigating, drifting and securing of all
logs, boards, lumber and timber of every kind
which may be placed in the said river, and also
of erecting, constructing and maintaining such
side or branch boom as may be convenient for such
purpose, and with power and authority also to
make any improvements in the bed of the said
river between the points above mentioned, which
may be reasonably convenient and necessary to
render the same navigable to the best advantage
for lumber and timber of every kind.

Sec. 2. And be it enacted, That the said Com-
pany shall be liable for any and all damages by
reason of the erection of any boom or booms or
any works appurtenant thereto, which said dam-
ages shall be ascertained, if the parties be unable
or incompetent to agree, by a jury of condemna-
tion, as provided in the succeeding section of this
Act ; and said jury shall be summoned at the in-
stance of either the property owner or the said
