manner before described, and when the verdict is
confirmed and the valuation paid, or tendered to
the owner or owners, or their agents or represen-
tatives, or paid into the said Court, the said Com-
pany shall be entitled to the estate and interest in
the same as fully as if conveyed by the owner or
owners, and the said verdict shall be recorded
among the land records of Worcester County, at
the expense of said Company.

 

Sec. 7. And be it enacted, That whenever it be-
comes necessary that an inquisition be held on any
lands or water rights, as aforesaid, the said Com-
pany may enter upon, occupy and use the same
immediately after the same shall have been viewed
by said jury.

Inquisition.

Sec. 8. And be it enacted. That if any person or
persons shall injure the said darn or inlet, or any
of the works connected therewith, they shall forfeit
and pay the damages sustained therein, to be re-
covered with costs of suit in the name of said cor-
poration, before any Court of Justice, or any Jus-
tice of the Peace having cognizance thereof.

Forfeiture.

Sec. 9. And be it enacted, That for and in con-
sideration of the expenses the said Company shall
incur in constructing works for opening said navi-
gation, and for stopping and darning the said Bay,
as aforesaid, and for keeping the same in repair,
the said works, and the said Inlet and dam with
all their profits, shall be and are hereby vested in
the said corporation forever, and the said Compa-
ny may demand and collect, by law if necessary,
reasonable tolls for the use of said Inlet from the
owner, owners or agents of all vessels or boats
navigating the same, and for all use of said dam.

Sec. 10. And be it enacted, That nothing fn this
Act shall be so construed as to allow said Company
banking privileges.

Sec. 11. And be it enacted, That this Act shall
take effect from the date of its passage, and the
General Assembly reserves the right to alter or re-
peal this Act at pleasure.
