Proviso.

such regulations as the by-laws shall prescribe ;
or the corporation may by suit recover the same
from the holder of the stock at the time of the as-
sessment thereof. Provided that the Board of Di-
rectors of said Company shall have power to re-
ceive payments for the whole or any parts of any
subscription to, the capital stock of said Company
either in land or money, and if in land, then at
such price, valuation or terms as may be agreed
upon by the subscriber and those appointed and
empowered to receive such subscription.

Powers.

Sec. 11. And be it enacted, That the said cor-
poration shall have authority to construct, main-
tain and work the Railroad, mentioned in the first
Section of this Act, and branches or lateral Rail-
roads from its main line twenty miles in length.

Toll.

Sec. 12. And be it enacted. That for transpor-
tation on its Railroads and branches or any part
thereof the said corporation shall have a right to
charge and collect as toll and transportation
charges at rates not exceeding eight cents per ton
oT property, or six cents per passenger for each
mile of transportation, but for any distance twenty-
five cents may be charged for a passenger or for
any quantity of freight.

Tracks and
bridges.

Sec. 13. And be it enacted, That the said Rail-
road and branches may be constructed with as
many sets of tracks as the corporation shall deem
proper, and the corporation may construct and
maintain all bridges, wharves and other structures
and works which it shall deem necessary for the
purpose of its incorporation, but the land which it
shall have a right to acquire for the construction
of such road, branches and works shall not exceed
sixty-six feet in width, besides the necessary spaces
for slopes along the main line or any branch gen-
erally, and twenty acres at either terminus of the
main line or a branch, and ten acres at any inter-
mediate station.

Condemn.

Sec. 14. And be it enacted, That if the corpora-
tion cannot agree with the owner for the purchase,
use or occupation of land, gravel, earth, timber
or other material required for the construction,
enlargement or repair of any of its works, or if
the owner be a married woman, infant, non compos
