may be changed by a two-third vote of the Direc-
tors at a meeting when notice has been given at a
previous meeting.

Locate road.

Sec. 7. And le it enacted, That the said Com-
pany are hereby authorized to locate said Turn-
pike Road upon the beds of the hereinbefore de-
scribed county roads or as near thereto as may
seem to the Directors roost advisable, commencing
at a point as hereinbefore described, and termina-
ting at Reisterstown, and said Turnpike Company
shall have power to construct bridges over streams,
and may agree or contract with owners of land
and materials for the use of said Turnpike, and
when necessary, by giving twenty days notice to

the interested parties, may apply to the Justice of
the Peace of said county, who shall issue a war-
rant to the Sheriff of the county to summons
twenty disinterested persons to meet upon said
lands, and after striking off four such jurors by
the Company and four by the opposing parties,
the remaining twelve on oath or affirmation, as the
case may be, shall value the damages upon a fair
estimate of the advantages and disadvantages to
the owners of lands, and in writing, shall de-
liver their verdict to the Clerk of the Circuit Court
of the county to be recorded, either party having
a right of appeal to the Circuit Court, and the
amount of damages to be paid by said Turnpike
Company to those for whose benefit such damages

Proviso.

are assessed, provided, however, said Company
shall have the right to enter upon any lands for
survey, preliminary to condemnation for such ser-
vices as above described, the Justice, Sheriff, Clerk
and Jurors shall be entitled to receive the usual
fees in such cases.

Tolls.

Sec. 8. And le it enacted, That as said Road is
finished and opened for travel, the said Company
shall be authorized to erect one or more toll gates
thereon, and to charge and receive tolls at such
rates, terms, conditions and limitations as are pre-
scribed and binding upon the Baltimore and York
Road Turnpike Company as set forth in its char-
ter and supplements thereto.

Dividend.

Sec. 9. And be it enacted, That no dividends of
the earnings of said Company shall be declared
unless the said Turnpike shall be kept in good
