SEC. 4. And be it enacted, That the plea of non damnaficatus,
shall not be received or allowed to any suit now or hereafter
brought upon the bond of any clerk of the county courts, clerk
of the court of appeals, register in chancery, or register of wills.

SEC. 5. And be it enacted, That the county clerks and re-
gisters of wills, shall hereafter renew their bonds at the fall
term of the county court, in every second year.

Salary and
percentage.
|
AN ACT Supplementary to an Act,* to regulate Lotteries.
SEC. 1. Be it enacted, by the General Assembly of Maryland,
That each of the commissioners of lotteries shall be entitled to
receive a salary of one thousand dollars, payable quarter-yearly,
and over and above the said salary, the said commissioners shall
be entitled to receive a per centage upon the net proceeds of the
state lotteries, so far as the said net proceeds shall exceed the
sum of thirty thousand dollars, in the year, counting from the
thirtieth day of November, in each year, and beginning from
the thirtieth day of last November, at the rate of five dollars on
every hundred dollars of the said net proceeds, to be equally

divided between them; Provided however, That the same, in-
cluding the salary, as aforesaid, shall not exceed in any one
year, two thousand dollars.

SEC. 2. And be it enacted, That the said commissioners shall
be and they are hereby authorized and required, annually to
devise and determine upon any number of scheme or schemes
of lotteries to be drawn in the city of Baltimore, as experience
to them shall have, or may hereafter prove most conducive to
the improvement of this branch of the public revenue, and to
prepare, sign and dispose of tickets in the said lottery or lotte-
ries, and they may allow a rate of discount not exceeding five
per centum upon such tickets from the scheme price of the said
tickets.
SEC. 3. Repealed by 1828, ch. 129, sec. 20.

SEC. 4. And be it enacted, That before proceeding to any
drawing of any of the said lotteries, the said commissioners
shall cover and enclose under their hands and seals, all the
tickets remaining in bank, being the property of the state, and
deliver the same to the treasurer of the western shore, or depo-
site the same, enclosed and sealed as aforesaid, in the branch
bank of the United States, or other bank, that may have been
approved as aforesaid, the said commissioners retaining a list of
the numbers of the said tickets, and transmitting a copy of the
said list to the said treasurer.
