Option
allowed.

SEC. 2. And be it enacted, That any person or persons
from whom any money is withheld by a constable, or in whose
case a default has been entered against a constable, shall have
it in their option either to pursue the course laid down by this
act, or to avail themselves of the remedies already existing.

SEC. 3. And be it enacted. That a certificate from the clerk
of the county, stating who are securities for a constable, and the
time when they became such, shall be sufficient evidence of the
fact and it shall not be necessary to produce a full copy of the bond.

SEC. 4. And be it enacted, That all former acts or parts of
acts, inconsistent with, or repugnant to the provisions of this
act, be and they are hereby repealed.

Penalty for
purchasing
tobacco
without
certificate.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the first day of May next, it shall not be
lawful for any person to purchase of any free negro or mulatto,
any quantity of tobacco in transfer or parcels, under the penalty
of one hundred dollars for every such offence, to be recovered
by indictment in the county court of the county where such
person purchasing the same may reside, one-half shall go to the
informer, and the other half to the county, unless the free
negro or mulatto, selling the same shall, at the time of offering
the said tobacco for sale, produce a certificate from a justice of
the peace of the county, certifying the quantity and quality
thereof.

SEC. 2. And be it enacted, That no justice of the peace shall
give any certificate to any free negro or mulatto, unless the said
free negro or mulatto, (as the case may be,) shall prove by one
or more respectable citizens of the neighbourhood where he,
she, or they may reside, that the tobacco was made by such
free negro or mulatto, or honestly acquired.

SEC. 3. And be it enacted, That it shall and may be lawful
for the justices of the peace, granting such certificates to charge
and receive for the same, the sum of twenty-five cents.
