LAWS OF MARYLAND.— 1825.

person or persons, body or bodies politic or corporate, shall have
notice that the person or persons making and entering into such
contract, or on whose behalf such contract is made or entered

 

into, is, or are an agent or agents, factor or factors ; Provided,
That such contract and payment, be made in the usual and
ordinary course of business, and that such person or personst
body or bodies politic or corporate, shall not when such contract
is entered into, or payment made, have notice that such agent
or agents, factor or factors, is or are not authorized to sell the
goods, wares or merchandise, or to receive the purchase money
for the same.

Proviso.

SEC. 4. And be it enacted, That in case any person or persons,
body or bodies politic or corporate, shall after the first day of
October next, accept and take any such goods, wares or mer-
chandise, or any such document as aforesaid, in deposite or
pledge fron any person or persons so entrusted with the same,
or to whon the same may be consigned, or who may be en-
trusted with, and in possession of any such bill of lading, store-
keeper's orinspector's certificate, order for the delivery of goods,
or other such document shewing possession, without notice as
aforesaid, as a security for any debt or demand existing before
the time of such deposite or pledge, then such person or per-
sons, body or bodies politic or corporate, so accepting or taking
such goods, wares or merchandise, or document aforesaid, in
deposite or pledge, shall acquire no further or other right, title
or interest, in the said goods, wares or merchandise, or in any
such documeit aforesaid, than was possessed or could or might
have been enforced, by the said person or persons so possessed
and entrusted as aforesaid, at the time of such deposite or pledge ;
but such persoi or persons, body or bodies politic or corporate,
so accepting or taking such goods, wares or merchandise, or
such documents aforesaid, in deposite or pledge, shall and may
acquire, possess and enforce, such right, title or interest as was
possessed, and night have been enforced by such person or
persons so possessed and entrusted as aforesaid.

SEC. 5. And be it enacted. That from and after the passing of
this act, it shall ani may be lawful to, and for any person or
persons, body or bodes politic or corporate, to accept and take
any such goods, wares or merchandise, or any such document
aforesaid, in deposite or pledge, as a security for any debt or de-
mand existing before he time of such deposite or pledge, from
any such agent or agents, factor or factors, notwithstanding
such person or persons, body or bodies politic or corporate, shall
have such notice as aforesaid, that the person or persons making
such deposite or pledgees or are an agent or agents, factor or
factors; but then in that case, such person or persons, body
or bodies politic or corporate, shall acquire no further or other
