act, and the same shall be levied and collected in the same
manner that other county charges are now by law levied and
collected.

CHAPTER 50,

AN ACT to limit the operation and effect of Mortgages.

 

Be it enacted, by the General Assembly of Maryland, That
no mortgage or deed of that nature, that may be executed after
the first day of August, one thousand eight hundred and twenty-
six, shall operate or be construed to operate, either in law or
in equity, as a lien or charge, on any estate or property whatso-
ever, for any other or different principal sum or sums of money
than the principal sum or sums that shall appear on the face
of such mortgage, and be specified and recited therein, and
particularly mentioned and expressed to be secured thereby, at
the time of executing the same.

CHAPTER 51.
A further additional SUPPLEMENT to a supplementary ACT, entitled, an
Act for the recovery of Small Debts out of court, passed at December
session, eighteen hundred and twenty-four, chapter one hundred and
thirty-eight.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the first day of May next, in all cases
where any injury shall be done to any real or personal property
within this state; and where the damages claimed or laid, shall
not exceed the sum of fifty dollars, it shall and may be lawful
for any one justice of the peace of the county where the same
shall have been committed, or where the trespasser may reside,
to hear and determine the matter in controversy between the
parties, and to give judgment against the person or persons by
whom the trespass had been committed, for such damages, as
to the said justice may appear to be reasonable and just, not
exceeding the sum of fifty dollars as aforesaid.

SEC. 2. And be it enacted, That the several provisions of the
act of December session, eighteen hundred and twenty-four,
chapter one hundred and thirty-eight, shall extend and apply
with equal force to this act.

SEC. 3. And be it enacted, That all laws contrary to or in-
consistent with the provisions of this act, be, and the same are
hereby repealed.
