SEC. 2. And be it enacted, That it shall and may be lawful
for all incorporated bodies in this state, tirhich are not by law
authorized to make a common seal, to make one and to use the
same in all acts where it is necessary by law to use the same.

CHAPTER 232.

AN ACT taxing or licensing certain Dealers in Lottery Tickets and others.
The policy of the state on the subject of dealers in lotteries, has vacil-
lated within the last few years, and its regulations are scattered through
the acts of many sessions, and not un frequently come in collision with the
provisions of earlier enactments, and yet contain no repealing clause. It
is proper that the responsibility of rejecting those earlier provisions and
giving a construction to the several acts operating upon this branch of the
public police, should be thrown on the Judiciary. The following laws are
the only ones relating to lottery dealers, 1826, ch. 67, 251 ; 1827, ch. 160 5
1828, ch. 129; 1829, ch. 188; 1831, ch.79.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the first day of May next, it shall not be
lawful for any person or persons whomsoever, to open, set up,
exercise or keep by himself or themselves, or by any other per-
son or persons, any office or other place for selling any ticket or
tickets, or for registering the number or numbers of any ticket
or tickets in any public or private lottery authorized or not au-
thorized by any law of this state or any other state or country,
or for registering the numbers or number of any ticket or tickets
in any other lotteries, and whether authorized by any law, or
any other state or country or not, or by writing, printing, or
otherwise to publish the setting up, opening or using any such
office or offices or other place, without having first obtained a
license from the county court where such person or persons
shall reside ; and if such person or persons shall reside in the
city of Baltimore, then from the city court of Baltimore.
By 1831, ch. 79, sec. 1, commissioners of lotteries are empowered .to
grant licenses to vend tickets in foreign or domestic lotteries.

SEC. 3. See 1826, ch. 251, sec. 1.

SEC. 4. And be it enacted, That it shall be the duty of the
several county courts and of Baltimore city court, to give this
act in charge to their respective grand juries.

CHAPTER 240.

AN ACT to repeal part of an Act therein mentioned.

This act to
be given in
charge.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That all such parts of the act of assembly passed at September
session, seventeen hundred and twenty-three, chapter fifteen,
which directs punishment of negro or other slaves by cropping
the ear, be and the same is hereby repealed.
