LAWS OF MARYLAND.— 1801.

 

security, to be approved of by the governor and council, in the
penalty and according to the form herein after directed and pre-
scribed ; and all bonds executed in virtue of this act shall be
recorded among the records of the general court, and the origi-
nal shall be returned to the governor and council, to be by
them filed.
By 1323, ch. 195, the bond is to be renewed every second year, and to
be approved by the governor, and to be recorded in the clerk's office of the
county where the party resides.

SEC. 2. And be it enacted, That it shall be, and it is hereby
declared to be, the duty of the governor and council, at all times
hereafter, when in their judgment and opinion the securities of
any treasurer appointed, or hereafter to be appointed, have or
are likely to become invalid, to demand and require such trea-
surer forthwith to give bond to the state of Maryland, with
security to be approved of by the governor and council, in the
penalty, and according to the form, directed and prescribed by
this act, and in case of refusal by any treasurer now appointed,
or hereafter to be appointed, to give bond, with security, as
aforesaid, within twenty days after the same shall be demanded
and required by the governor and council as aforesaid, such
refusal shall be, and it is hereby declared to be, a disqualifica-
tion within the constitution, and the governor and council are
hereby required to proceed forthwith to appoint a fit and proper
person to fill the vacancy occasioned thereby, during the recess
of the general assembly, according to the constitution and form
of government.

Penalty and
form of the
bond.

SEC. 3. A/id be it enacted, That hereafter the penalty of the
bond to be executed in virtue of this act by the treasurer of the
western shore, and his securities, shall be in a sum not less
than fifty-four thousand dollars, and the penalty of the bond to
be executed in virtue of this act by the treasurer of the eastern
shore, shall be in a sum not less than twenty thousand dollars,
and the form of said bonds respectively shall be as follows, to
wit: ' Know all men by these presents, that we —— , are held
and firmly bound unto the state of Maryland in the full and
just sum of —— dollars current money of Maryland, to be paid
to the said state, to which payment well and truly to be made
and done, we bind ourselves, our heirs, executors and adminis-
trators, jointly and severally, firmly by these presents. Sealed
with our seals, and dated this —— day of —— , anno Domini
eighteen hundred and —— . Whereas the above named
was, ou the —— , in the year one thousand eight hundred and
—— , appointed by the house of delegates of Maryland the
treasurer for the — — shore of Maryland, and hath agreed to
accept the said appointment. Now the condition of the above
obligation is such, that if the above bound —— do and shall in
