In cases where the courts of law in this state were authorized to sen-

 

tence a negro or mulatto slave to be hung or undergo a confinement

 

in the penitentiary, they shall have authority in their discretion td

 

sentence such negro, &c. to be hung or banished the state, and sold

 

for the use of the county, where such negro, &c. shall be con-
