damages found by the jury, and costs, whereon process of exe-
cution may be had as aforesaid.

Clerk not
liable, &c.

SEC. 7. And be it enacted, That any county clerk issuing
replevin in virtue of a magistrate's warrant as aforesaid, shall
not be liable to the penalties of the act to which this is a sup-
plement.

When to
be tried.

SEC. 8. And be it enacted, That all replevins sued out in
virtue of this act shall be tried and determined at the court to
which the same shall be returnable, unless, upon special rea-
sons shewn to the court, on affidavit in writing, they shall
otherwise order.

Affidavit to
be lodged,
&c.

 

SEC. 9. And be it enacted, That every justice shall lodge
with the county clerk of his county, to be by him safely kept,
the affidavit or affirmation of the party applying for a warrant
as aforesaid ; and any party wilfully swearing or affirming
falsely in the premises, shall, upon conviction in a court of
law, be liable to the penalties of wilful and corrupt perjury.
SEC. 10, 11. Limited in their operation to certain cases.

Proviso.

SEC. 12. Provided always, That before any clerk shall issue
a writ of replevin in virtue of this act, the plaintiff or plaintiffs
shall enter into bond, with two sufficient sureties, in double the
value of the property to be replevied, in the same manner as in
other cases of replevin.

AN ACT to continue the acts of Assembly therein mentioned.

Three acts
continued.

Be it enacted by the General Assembly of Maryland, That
an act, entitled, an act to ascertain the allowance to the mem-
bers of the general assembly to defray the expense of their
attendance, passed April session, seventeen hundred and eighty-

seven,* be and is hereby continued until the thirtieth day of
October, seventeen hundred and ninety-seven, and to the end
of the next session of assembly that shall happen thereafter ;
that another act of assembly, entitled, an act for the regulation
of officers' fees, passed November session, seventeen hundred

and seventy-nine,t and one other act for the regulation of offi-
cers' fees, and for other purposes, passed October session, seven-
