tion district, as soon as practicable, and at all elections there-
after to be held in said Howard district alone, or as a part of
Anne Arundel county, the voters within the limits of each of
said election districts, shall vote at the place where the. elec-
tion is to be held in such district.

SEC. 4. And be it enacted. That at the next annual election,
and at each annual election thereafter, the voters of each of
said election districts, who are now or may at the time of the
election be qualified to vote for members of the house of dele-
gates, shall vote at their respective places of voting, for one
person who shall be a resident of such election district, and
who has the same qualifications as candidates for the house of
delegates, and it shall be the duty of the judges of election to
make such returns of said election as is by law required in
case of an election for sheriff, and the three persons thus
elected from the three election districts, shall constitute a
board of commissioners, who shall be styled the commissioners
of Howard district, and shall continue in office for one year
from the time of election, and until their successors have
qualified, and shall have within said Howard district, all the
powers, rights and duties, and be subject to all the liabilities
which now appertain to the county commissioners of Anne
Arundel county, and such further as may be imposed upon
them by this or any other act of assembly ; and upon the elec-
tion and qualification of such commissioners, they shall assume
all the rights and duties, and possess themselves of every thing
belonging to the preceding board of commissioners, and the
powers and rights of the county commissioners shall cease and
determine within the limits of Howard district, upon the pas-
sage of this act, except so far as powers may be specially con-
ferred upon them by this act ; and the said district shall have
the same right and power to acquire and hold property, that
any county of this state has.

SEC. 5. And be it enacted, That if any commissioner shall
die, resign, refuse to serve, remove from the district in which
he was chosen, or neglect to qualify within thirty days, as com-
missioner, or in case of a tie, the remaining commissioner or
commissioners, shall appoint some person or persons to fill
such vacancy from the election district from which such com-
missioner or commissioners shall have been respectively
elected, or in which there shall be a tie.

SEC. 6. And be it enacted, That the said commissioners of
the district shall have authority, and it shall be their duty to
appoint for each of said three election districts, a number of
constables not exceeding five, and who shall in all respects
qualify as the constables of Anne Arundel county now do ; and
the said commissioners shall also appoint one person within
said Howard district, as the collector of the tax, and such per-
